1. Introduction and Agreement

Welcome to ETF Holdings ("we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of our website, etfholdings.com, and any related services, including our ETF directory, watchlist feature, and any content, tools, and functionalities offered on or through our platform (collectively, the "Service").

By accessing or using the Service, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree with these Terms, you may not access or use the Service.

2. Eligibility and Account Registration

2.1. To use certain features of the Service, such as the watchlist, you must register for an account. By registering, you represent and warrant that you are at least eighteen (18) years of age and are legally able to enter into this agreement.

2.3. You are responsible for maintaining the confidentiality of your account password and are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your password or account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this section.

3. Use of the Service

3.1. Permitted Use: The Service is for your personal, non-commercial use only. You may use the Service to browse and research ETFs, and to create and manage a watchlist of ETFs.

3.2. Prohibited Use: You agree not to:
a. Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
b. Copy, reproduce, distribute, or otherwise exploit any part of the Service without our express written permission.
c. Use any automated means (e.g., bots, spiders, scrapers) to access, collect data from, or otherwise interact with the Service.
d. Attempt to gain unauthorized access to the Service, other user accounts, or computer systems or networks connected to the Service.
e. Interfere with or disrupt the integrity or performance of the Service.
f. Use the Service to post or transmit any material that is defamatory, obscene, fraudulent, or otherwise objectionable.
g. Use the Service for any commercial purpose, including reselling or sublicensing the Service or its contents.

To the maximum extent permitted by applicable law, in no event shall ETF Holdings, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
a. Your access to or use of or inability to access or use the Service;
b. Any conduct or content of any third party on the Service;
c. Any content obtained from the Service; and
d. Unauthorized access, use, or alteration of your transmissions or content.

8. Governing Law

8.1. These Terms shall be governed and construed in accordance with the laws of Delaware, USA, without regard to its conflict of law provisions.

9. Changes to Terms

9.1. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

9.2. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
